Track Matrix Terms and Conditions

Definitions

“us”, “we” and “our” means Track Matrix, operated by Event Matrix.

“you”, “your” and “yourself” means the individual or organisation set out on the registration page annexed to these terms and conditions and shall include all or any additional drivers or passengers participating in the Event.

“Event” means the specific event details on the registration page annexed to these terms and conditions.

The “Track” means the track/track owner/event organizer at which the Event is takes place.

Booking and Payment

All events are offered subject to availability and on a strictly first come first served basis.

There shall be no formal and binding contract between us and you until the full amount due has been received by us.

Failure to pay the full amount requested will entitle us to cancel the registration without further advance notice to you.

Provisional registrations will be confirmed only once payment is received in full.

We reserve the right to cancel or refuse any registrations at our sole discretion.

Pricing

The current prices are shown on our website and will be confirmed at the time of booking.

There will be an additional charge for second drivers and passengers which will also be shown on the website and confirmed at the time of registration.

We reserve the right to change any of the prices advertised on our website without prior notice.

All prices are subject to the addition of 13% Ontario Harmonized Sales Tax.

Alterations and Cancellations

If you wish to cancel a registration fourteen days or more prior to the event, we will issue a credit note to be used for future Track Matrix events for the full amount paid less a $100 administration fee.

If you wish to cancel a registration less than fourteen days before the event, we will issue a credit note to be used for future Track Matrix events for the full amount paid less a $100 administration fee, only if the event is fully ‘sold out’ and we are able to re sell your place.

When the event is listed as not sold out, we will be unable to refund your booking. However, we can make a name change if you can find a replacement participant, there will be no charge for this.

Any credit note issued must be used within 18 months of the original booked event date.

We do not provide refunds for any reason.

There shall be no refund made by us if the Event is terminated either on the day of the Event or shortly before because of adverse weather or other matters which in our reasonable opinion are beyond our control.

Track Matrix cannot be held accountable for the cancellation of an event or the lack of participant attendance due to Force Majeure. Examples of Force Majeure below:

(a) the following Natural Force Majeure Events:

fire, chemical or radioactive contamination or ionising radiation, earthquakes, lightning, cyclones, hurricanes, floods, droughts or such other extreme weather or environmental conditions, unanticipated geological or ground conditions, epidemic, famine, plague or other natural calamities and acts of God;

explosion, accident, breakage of a plant or equipment, structural collapse, or chemical contamination (other than resulting from an act of war, terrorism or sabotage), caused by a person not being the affected Party or one of its contractors or subcontractors or any of their respective employees or agents;

(b) the following Political Force Majeure Events:

to the extent they take place in [country], acts of terrorists, blockade, border closures, travel sanctions, embargo, riot, public disorder, violent demonstrations, insurrection, rebellion, civil commotion and sabotage;

Compliance with Track Regulations

Track regulations imposed by each Track will be available from us by prior request and at the drivers briefing.

You agree to be bound by the Track regulations throughout the Event.

You must attend all drivers’ briefings held during the Event and sign all necessary driver and/or passenger waivers forms prior to participating in any Event.

The safety of your vehicle is your responsibility at all times. We reserve the right to refuse entry to any vehicle (without refund) if any fault or feature is believed could compromise the safety of the vehicle its occupants and or other circuit users.

Our Events are organised to cater for a wide variety of vehicles. There will be the opportunity for competition vehicles and historic/classic vehicles to be driven on circuit at certain designated events. It is important to note that circuit usage exerts greater pressure for longer periods on vehicles and their components in comparison to normal road use. This obviously highlights the need for particular attention to safety, and we recommend that drivers thoroughly inspect their vehicles prior to use on the circuit.

Competitive driving is strictly forbidden and any driving which, in our opinion is aggressive or inconsiderate will result in the driver being immediately excluded from the remainder of the Event without any refund.

All drivers, passengers and guests must wear at all times during the Event the appropriate wristband to acknowledge these terms and that they hold us and the Track free from any liability or blame arising from any risk associated with the Event to the extent set out in this document and waiver forms.

Please note that your compliance with these terms and conditions is in addition to and not substitution of the additional track regulations enforced by the Track. We reserve the right to exclude your participation in the Event or the remainder of the Event arising from your breach of these terms and conditions or any regulations imposed by the Track.

Risks Associated with the Event

You acknowledge and realise that your participation in the Event is potentially dangerous and that there are numerous risks associated with it. Such risks dangers include but are not limited to, collisions with spectators, vehicles, other drivers and/or fixed or moving objects and the negligence of other drivers. Further, you fully understand and realise that your participation in the Event, however unlikely, may result in serious bodily injury and/or death to yourself or others.

With the full knowledge and understanding of the potential risks referred to above and associated with your participation in the Event, you enter the Event voluntarily and fully accept and assume every such risk for loss, damage or injury (including death).

General

Unless we have first agreed in writing, we are not bound by any variation to these terms and conditions.

You agree and accept all of these terms and conditions and understand that we will use our reasonable efforts to ensure that all other participants at the Event abide by these terms and conditions, we cannot guarantee that these terms and conditions will at all times be complied with nor be held responsible or liable in any way for their non-compliance.

You agree that by completing the booking form and accepting these terms and conditions you are entering into a legally binding agreement with us to participate in the Event on our terms and conditions.

You declare that all the information supplied by you on the booking form is to the best of your knowledge and belief correct and that you have read and understood the terms and conditions and agree to all of them (including but not limited to those relating to waiver of liability and indemnity) in full.

Track Day Rules and Regulations

Pit Lane

Please note the pit lane and the track are strictly one way.

The pit lane speed limit is 60 km/h.

The pit lane must be kept clear between the marked boxes and the pit wall to allow emergency vehicle access.

It is forbidden to sit on the pit wall.

It is forbidden to re-fuel in the pit lane.

It is forbidden to store fuel in the garages or in the pit lane.

It is forbidden to smoke in pit lane or garages.

Attendees under 18 are not allowed on the circuit, in the pit lane or in the garages without guardian waiver signature.

Venue

Anyone reported driving recklessly or dangerously will be escorted from the venue.

No paddock bikes or other forms of unlicensed motorised transport are to be used on the venue at any time.

It is the driver’s responsibility to make sure his/her car adheres to the venue noise level.

Track

On entering the circuit, please keep to the right-hand side and do not move over until the circuit behind you is clear.

Use the first few laps to warm up your tyres and familiarise yourself with the circuit layout, grip levels, marshal posts, etc.

Leave plenty of space when you overtake other cars. The overtaking rules will be covered in the drivers’ briefing.

Use your mirrors regularly and if you see faster traffic behind you, signal them to pass in designated passing zones.

Any driver generating excessive, unnecessary or constant tire squeal, or deemed to be driving recklessly, or in a manner considered to endanger themselves or other track users will be black flagged, removed from the track and given a warning that such driving is inappropriate.

If the driver continues to give cause for concern a second black flag will be given to once again remove that driver from the circuit and he/she will be denied further access to the track for the rest of the day.

In case of an incident with vehicle damage, stay in your vehicle with your safety belts on until help comes. The exception is if there is fire. If you see an incident – do not stop – the circuit staff will deal with it

Anyone who ignores red flags or the direction of marshals will be asked to leave the venue – the marshals are there for your safety.

Any participant involved in an incident on circuit must report to a Track Matrix staff before going back out onto the circuit

Any vehicle involved in an incident will have to be checked by a Track Matrix staff before going back out onto the circuit

Single seater ‘formula’ type race cars are not permitted

Three wheeled cars are not permitted

Safety

All helmets worn by drivers and passengers must comply with current SNELL safety standards

Helmets must be worn and securely fastened at all times while out on the circuit

Seat belts or harnesses must be worn at all times at the venue. If your car does not have seat belts it will not be permitted to participate

If you have any problems with any other drivers on the day, please report to the Track Matix Team immediately.

No handheld video cameras are allowed in vehicles. Cameras are to be securely fastened and checked by a Track Matrix before going out onto the circuit. Exterior mounted cameras are not allowed

Medical

The ambulance has trained EMS staff onboard and will join the circuit via the pit lane. Please be aware that the ambulance has the right of way on the circuit and will only move if your vehicle is stationary.

Declaration & Indemnity

I confirm that:

  1. I am familiar with the nature of the activity I wish to undertake and accept that, despite Track Matrix taking all reasonable precautions, damage or injury may occur. I accept this and take part in the activity at my own risk.
  2. I am competent to take part, I am not taking any drugs (whether prescribed or otherwise) that may impair my ability to take part and I do not suffer from, and have no history of, any medical condition that could affect my ability to take part in this event.
  3. I will satisfy myself (by sighting lap or otherwise) that the track is acceptable to me with regard to its features and physical layout.
  4. I will comply with all information and instructions provided to me in relation to the activity given by any representative of Track Matrix at all times. In the interests of safety, I may be excluded from further participation in the activity if it is considered that for any reason my driving is below a level deemed acceptable. I am aware that other participants will be on the track at the same time as me.
  5. I hold a full valid road driving licence (drivers only) appropriate for any car that I drive on circuit. I will bring my licence to the activity and make it available for inspection on demand.
  6. I will satisfy myself that any car I intend to drive in the activity is fit to use, safe, and roadworthy. Any in-car camera or other equipment is safely and securely attached, using mounting systems specifically designed for that purpose. The use of my car is entirely at my own risk and I accept responsibility for any damage to my car however caused (whether caused by me or anyone else driving it or caused by another participant). I understand the availability of track day insurance and will decide whether to take out such coverage at my discretion.
  7. I understand I may be liable for any damage caused at the venue, including any damages to the circuit infrastructure (Armco barriers, barrier posts, pit garages, etc), and shall pay to Track Matrix an amount equal to the cost of any resulting repair or replacement. All necessary on and off circuit clean up costs may also be chargeable.
  8. I shall wear seat belts or harnesses at all times whilst in a vehicle, and a properly fastened crash helmet at all times whilst on the circuit.
  9. I understand neither Track Matrix nor any other company or organization connected with the event (or any of their respective employees or officers), any instructors or other participants (each a “Relevant Person”) shall be liable for any injury, loss, damage, claims, costs, expenses, or demands suffered directly or indirectly by me as a consequence of my attendance at or participation in this activity. This does not exclude any Relevant Person’s liability for personal injury or death caused by its negligence.
  10. I understand Track Matrix may take photographs and/or video footage of me during this event and may use such photographs or footage (including my likeness and image) for future promotional, marketing and publicity purposes in any media worldwide without notice or payment.
  11. I understand racing or any type of competition, including top speed attempts, is prohibited and that the purpose of the day is to allow participants to improve their skills and learn the basic handling and braking characteristics of the cars which they are using.
  12. I understand any insurance carried by Track Matrix/the circuit owners/the event location operator in respect of any liability which might arise out of the track day will be limited, and that my own auto, third party and public liability insurance (if any) is unlikely to cover me for my losses, liabilities or personal injury.
  13. I waive on behalf of myself and my successors, any claims in relation to the event, including for damages, injury or death sustained on the track and/or its facilities, against Track Matrix/the circuit owners/the event location operator, or any other registered participant on the event.
  14. I agree to make no claim against Track Matrix/the circuit owners/the event location operator in respect of any loss or injury suffered by me during the track day and to indemnify them against their costs and losses arising out of any claim made against them by anyone to the extent that such costs and losses are attributable directly or indirectly to my participation in the track day.
  15. I have read and agree with the above Declaration and Indemnity and agree that its terms will also apply to my participation in any future track day organized by Track Matrix unless I sign a subsequent Declaration and Indemnity which will then take precedence.

I fully understand that motorsport and track day activity can be dangerous and may involve injury or death.

Any event day specific waivers that you sign online via Speed Waiver or in person at the track will take precedence over this declaration.
